Who Can Get a Marriage License in Gatlinburg?
You do not need to be a Tennessee resident, a U.S. citizen, or a Sevier County local to get married here. People travel from all 50 states and dozens of countries to elope in the Smokies every year — that's exactly what makes Gatlinburg the wedding capital of the South and the second-most-popular wedding destination in the United States after Las Vegas.
Here's who qualifies:
Age requirements. Both applicants must be at least 18 years old. Tennessee law prohibits any marriage license from being issued to anyone under 17 years old, with no exceptions. If one applicant is between 17 and 18, the other applicant cannot be more than four years (48 months) older, and additional parental documentation is required. If you're a minor, contact the Sevier County Clerk directly at (865) 453-5502 before traveling.
Identification. Each of you needs a valid government-issued photo ID — driver's license, state ID card, military ID, or passport. Non-U.S. citizens must present a valid passport, which is the only acceptable form of ID for international applicants.
Both parties present. Tennessee requires both applicants to appear in person at the clerk's office. The clerk cannot issue a license to one person on behalf of another, and there is no proxy marriage option in Sevier County (with the narrow exception of incarcerated applicants, who must submit a notarized affidavit).
Marital history disclosure. If either of you has been divorced or widowed, you'll need to know the exact date the divorce was finalized or the date of your previous spouse's death. If you changed your name through a divorce and your driver's license still shows your old name, bring a certified copy of the divorce decree.
Same-sex couples. Same-sex marriage has been legal in Tennessee since June 26, 2015, and same-sex couples are issued marriage licenses on identical terms.
Cousin marriages. First-cousin marriages are legal in Tennessee. Tennessee law does prohibit marriage between direct lineal relatives (parent/child, grandparent/grandchild) and certain step-relationships.
How Much Does a Gatlinburg Marriage License Cost?
This is the area where most couples get pleasantly surprised — and where Sevier County has a unique advantage no other Tennessee county offers.
Out-of-State Couples: $41
If both of you have driver's licenses from outside Tennessee, your total marriage license fee in Sevier County is just $41. This dramatic discount exists because Sevier County is classified as a "premier tourist resort" under Tennessee state law, which exempts non-resident couples from the $60 state premarital course fee. It's one of the only counties in Tennessee where you get this break automatically, just for being from out of town.
Tennessee Resident Couples: $101
If either applicant holds a Tennessee driver's license or claims Tennessee residency, the fee is $101. The good news: you can knock $60 off that price by completing a four-hour premarital preparation course and presenting a notarized Certificate of Completion at the clerk's office. The certificate must be issued within one year of your license application date. Approved online courses are available for around $20 per person, and the Sevier County Clerk can also provide the certificate form directly.
Payment Methods
All three Sevier County Clerk locations accept cash (exact amount preferred) as well as Visa and Mastercard. A small processing fee applies to card transactions. If you pre-apply and pay online, expect the total to run slightly higher to cover online processing fees — typically around $108 for Tennessee residents.
What's Included
The fee covers your marriage license, the marriage certificate filing, and one free certified copy mailed to you after the ceremony. Additional certified copies are $5 each in person or $15 by mail. Certified copies are what you'll need later for name changes at Social Security, the DMV, and your bank.
Quick Answer: How to Get Married in Gatlinburg
Here's the short version, because we know most of you just want the bottom line:
Both of you show up in person at any Sevier County Clerk's office (Gatlinburg, Sevierville, or Pigeon Forge).
Bring a valid government-issued photo ID and your Social Security number.
Pay the fee: $41 if you're both from out of state, $101 if either of you is a Tennessee resident. Card or cash accepted.
Get married the same day. Your license is valid for 30 days anywhere in Tennessee.
That's it. There is no waiting period in Tennessee for out-of-state couples, and no blood test is required. You can land in Knoxville at 9 AM and be legally married in the Smoky Mountains by 2 PM.

What to Bring to the Clerk's Office: The Complete Checklist
Print this or screenshot it before you leave for your trip. Forgetting one of these items is the #1 reason couples have to delay their wedding day.
For both applicants:
☐ Valid government-issued photo ID (driver's license, state ID, military ID, or U.S. passport)
☐ Social Security card OR your Social Security number memorized (non-U.S. citizens are exempt — passport only)
☐ Payment: $41 (out-of-state couples) or $101 (Tennessee residents). Cash, Visa, or Mastercard.
If either of you has been previously married:
☐ Exact date of divorce or date of deceased spouse's death
☐ Certified copy of divorce decree (only if the bride's driver's license still shows a prior married name)
For non-U.S. citizens:
☐ Valid passport (this replaces the photo ID and Social Security card requirements)
Optional but helpful:
☐ Notarized Certificate of Completion from a four-hour premarital course (only if you're a Tennessee resident wanting the $60 fee waiver)
☐ Pre-application confirmation receipt (if you pre-applied online)
Tennessee does not require a blood test, a witness at the clerk's office, or any kind of medical certificate. You don't need a copy of your birth certificate unless you don't have a photo ID.
Pre-Application: How to Skip Some of the Paperwork
Sevier County offers an online marriage license pre-application through the county clerk's website (seviercountytn.gov). You can fill out the form up to 30 days in advance and pay with a Visa or Mastercard. When you arrive at the clerk's office, you bypass the data entry and just sign for the license.
A few things to know about pre-applying:
You still must appear in person. Pre-applying online doesn't eliminate the in-person requirement — both of you still need to physically show up with photo ID to sign and pick up the license.
The 30-day window starts when you sign, not when you pre-apply. Your license is good for 30 days after you physically sign for it at the clerk's office, so don't sign too far in advance.
Pre-application saves about 15-20 minutes at the counter — useful in peak season when offices are busy.
We recommend pre-applying if your trip is short and every hour counts. If you have a full day or two in town before the ceremony, walking in cold is perfectly fine.
Common Mistakes to Avoid
After helping hundreds of couples elope in the Smokies, we see the same handful of mistakes over and over. Most are easy to sidestep with a little planning.
Visiting the Gatlinburg office on a Tuesday or Thursday. It's closed both days. Couples land in town on Tuesday morning, drive straight to Reagan Drive, and find a locked door. Always check the day of the week first.
Forgetting one partner's ID. Both of you must be present and both of you must have valid photo ID. A photocopy doesn't count. If your driver's license is expired — even by a day — bring your passport as backup.
Mismatched names. If one of you has been divorced and your current driver's license still shows your married name (or vice versa), bring the certified divorce decree. The names on the license must match your legal identification.
Picking up the license too early. The 30-day clock starts the moment you sign, not the moment you arrive in Tennessee. If you're spending two weeks in the Smokies before the ceremony, that's fine — but don't pick up the license eight months out "to be safe."
Assuming Saturday hours. The Gatlinburg office used to be open Saturdays and isn't anymore. The Pigeon Forge office is the only Saturday option, and it closes at 1 PM. Plan accordingly.
Holidays. Sevier County offices close for all federal holidays plus a few county-specific dates (election days, for example). If your trip falls near a holiday, call ahead to confirm hours.
After You Get the License: What Happens Next
Once the clerk hands you your marriage license, you're cleared to get married any time within the next 30 calendar days, anywhere in the state of Tennessee. The license is the legal authorization for the ceremony — not the marriage itself.
Who Can Perform Your Ceremony
Tennessee recognizes a wide range of officiants: ordained ministers, judges, justices of the peace, county mayors, and most members of the clergy. Most online ordinations (such as through the Universal Life Church) are accepted in Sevier County, though we always recommend confirming with your officiant in advance. Our team works with experienced local officiants who handle the paperwork seamlessly.
Witnesses
Tennessee law does not require witnesses for a marriage to be valid — but our officiants typically sign as the witness if you're eloping just the two of you, or your photographer is happy to step in. If you'd like to bring family or close friends, two witness signatures are common but not legally required.
Filing the Signed License
After the ceremony, your officiant signs the license and is responsible for returning it to the Sevier County Clerk's office (or the issuing county) for filing within three days. The county then mails you a certified copy of your marriage certificate — usually within 2-4 weeks. This is the document you'll use for name changes, insurance updates, and tax filings.
If You Don't Use the License Within 30 Days
If 30 days pass and you haven't held the ceremony, the license becomes void. You'll need to return to a clerk's office, pay the fee again, and get a new license. This rarely happens with elopement couples — but it's a real risk if you pick up the license too early.
